Terms of Use

1. These General Terms and Conditions shall expressly regulate the relations arising between Vip Ventas Málaga S.L., Avenida de los Jardines 22 Mijas Costa 29649 Málaga, and with CIF B92741446 and third parties (hereinafter, “Users”) who register as users and/or purchase products through the site’s online store or in one of its physical stores in Spain.
2. OBLIGATIONS OF THE USER

2.1 The User undertakes, in general, to use the Store, to acquire the Products and to use each of the services of the Store diligently, in accordance with the law, morality, public order and the provisions of these General Conditions, and must also refrain from using them in any way that may impede, damage or deteriorate the normal operation and enjoyment of the Store by Users or that could injure or cause damage to the goods and rights of Vip Ventas Málaga S.L., its suppliers, Users or in general of any third party.

3. PRODUCTS AND PRICES

3.1 Vip Ventas MálagaS.L. reserves the right to decide, at any time, the Products offered to Users through the Online Store, which may vary. In particular, Vip Ventas Málaga S.L. may at any time add new Products to those offered or included in the Store, it being understood that unless otherwise provided, such new Products will be governed by the provisions of these General Conditions. Likewise, Vip Ventas Málaga S.L. reserves the right to stop providing or facilitating access to and use at any time and without prior notice of any of the different types of Products offered in the Store.

3.2 The Products included in the Store will correspond as faithfully as possible as possible by the Web display technology to the Products actually offered. The characteristics of the Products and their prices appear in the Store. The prices indicated in the Store are in Euros and include the corresponding % of VAT, unless otherwise indicated. In case of sale to areas with different rates, the price will be automatically recalculated when filling in the shipping data.

4. METHOD OF PAYMENT FOR THE PRODUCTS

4.1 Within a maximum period of twenty-four (24) hours, Vip Ventas Málaga S.L. will send an email to the User, confirming the purchase in the case of making purchases through the Website. This email will assign a reference code forthe purchase, and will detail the characteristics of the Product, its price, shipping costs and the details of the different options for making the payment of the Products to Vip Ventas Málaga S.L.

4.2 The User who purchases a product through the Store must make the payment through the payment systems specifically detailed in the Store.

4.3 The order confirmation sent by Vip Ventas Málaga S.L. is not valid as an invoice, only as proof of purchase. Vip Ventas Málaga S.L. will send the invoice and/or receipt corresponding to the Product along with the Product.

6. CUSTOMER SERVICE

6.1 For any incident or complaint, the User may send an email to the address  ventas@vipventas.es

7. HOME DELIVERY SERVICE

7.1 The territorial scope of sales through the Store is exclusively for the marked territories, so the delivery service will only be for that territory. Products purchased through the Store will be sent to the delivery address indicated by the User once payment has been verified, with the maximum delivery period being thirty (30) days established by default in the Law. The average delivery time ranges from 1 to 3 days.

7.2 The delivery service of Vip Ventas Málaga S.L. is carried out in collaboration with different logistics operators of recognised prestige. Orders will not be served at P.O. Boxes or at hotels or other non-permanent addresses.

7.3 The cost of shipping is not included in the price of the Products. At the time of purchase of the Product, the User will be informed of the exact shipping cost.

8. INTELLECTUAL AND INDUSTRIAL PROPERTY

8.1 The User acknowledges that all the elements of the Store and each of the Products, the information and materials contained therein, the brands, the structure, selection, arrangement and presentation of their contents, and the computer programs used in relation to them, are protected by the intellectual and industrial property rights of Vip Ventas MálagaS.L. itself. or third parties, and that the General Conditions do not attribute to it any other rights with respect to said industrial and intellectual property rights other than those specifically contemplated therein.

8.2 Unless authorised by Vip Ventas Málaga S.L. or, where appropriate, by the third party holdersof the corresponding rights, or unless legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available, or allow access to the public through any form of public communication of any of the elements referred to in the previous paragraph. The User must use the materials, elements and information accessed through the use of the Store only for his/her own needs, undertaking not to carry out, either directly or indirectly, a commercial exploitation of the materials, elements and information obtained through them.

8.3 The User must refrain from circumventing or manipulating any technical devices established by Vip Ventas Málaga S.L. or by third parties in the Store.

9. DATA PROTECTION

9.1 All the information provided through the registration form, as well as the information from the transactions carried out, will be kept in a data file of Vip Ventas Málaga S.L. until its cancellation is requested. The processing will be used for the development and execution of the sale, the personalized attention of the products and services acquired and, until the opposition is communicated, for the improvement of said service, as well as the promotion of its own products and services and those of third companies linked to Vip VentasMálaga S.L. In this way, the sending, including through electronic means, by the aforementioned entities, of commercial communications and promotional offers and competitions is authorised.
